Alex de Jongh
Solicitor

Alex qualified in 2002 and has been a member of BWB's Dispute Resolution group since September 2003. He handles a busy and varied caseload covering a wide range of contentious matters. He has extensive experience of High Court and county court proceedings, and of alternative methods of dispute resolution, including mediation.

• Practised at Olswang (2002-3) specialising in defamation, administrative law and commercial litigation before joining BWB in September 2003

Dispute resolution
Alex advises companies, individuals, charities and social enterprises on disputes in areas including:

• Defamation and malicious falsehood (see below)
• Contractual and tortious disputes of all kinds
• Fraud and asset recovery, including obtaining injunctive relief
• Professional negligence claims, in particular involving solicitors and accountants
• Shareholders’ disputes
• Disputes with suppliers of goods and services
• Contested probate/legacy disputes
• Debt recovery matters, both simple and complex
• Insolvency, both corporate and personal
• Banking disputes
• Building and construction disputes


Recent and ongoing matters include:
• Acting for the defendants in two separate matters involving worldwide freezing injunctions and search orders
• Acting as assistant supervising solicitor on the execution of three search and seize orders
• Several disputes with suppliers to commercial organisations and charities
• Numerous successful actions for the recovery of substantial debts owed to clients
• Advising a major PLC in breach of warranty/misrepresentation proceedings and subsequently in a substantial negligence claim against its former solicitors
• Advising a high-profile actor on a claim in negligence against his former immigration solicitors
• Providing urgent advice to a charity concerned about infringement of copyright/passing off
• Advising in relation to a dispute relating to a client’s entitlement to a share of an earn out agreement
• Advising a major charity in relation to disputes with local authorities as to its entitlement to claim charitable rates relief
• Advising a UK company director regarding prosecutions brought against him by the DTI/Companies House, and successfully persuading the prosecution that those charges should be withdrawn.

Defamation
Alex frequently provides pre-publication advice to charity and media clients as to the risks posed by controversial publications. These range from film scripts to charity campaign materials.

Alex also has extensive experience of libel and slander disputes arising after publication. Examples of his recent work include securing a live correction and apology on a flagship BBC radio programme for a controversial public figure. Acting for defendants, he recently advised a former cabinet minister in relation to threatened proceedings arising from a television documentary, and negotiated a favourable settlement for a leading trade publication threatened with libel proceedings. He frequently advises in relation to internet publications, such as defamatory postings in chat rooms and on message boards.

Background
Alex graduated in 1998 with a first in Modern History from Magdalen College, Oxford. He trained at a large City firm and qualified in 2002. He completed the CPE and LPC at the College of Law in London.

Prior to joining BWB he specialised in defamation at a leading media litigation practice.

He is a senior pro bono adviser at the Blackfriars Law Centre.
